Terms of Service

These Terms of Service ("Terms") govern your access to and use of ShipmentBeat ("we", "us", "our"), including shipmentbeat.com, app.shipmentbeat.com, and related workspace features (the "Service"). By creating an account or workspace, or by using the Service, you agree to these Terms.

1. The Service

ShipmentBeat provides ocean shipment tracking and related maritime data tools, including container and B/L tracking, sailing schedules, and vessel, port, and voyage information, through a public website and a logged-in workspace.

Tracking data is sourced from ocean carriers, AIS providers, and other third-party sources. The Service aggregates and normalizes this data but does not originate it.

2. Accounts and workspaces

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account and organization workspace.

You must be at least 16 years old and use the Service for business purposes only. If you create an account for a company, you represent that you have authority to bind that company to these Terms.

Creating an account through the registration form or the first-tracking / quick-tracking flow creates a workspace. Completing that flow is acceptance of these Terms.

3. Credits and payment

The Service operates on prepaid credits at a public exchange rate of US$1 = 10 credits. Current consumption rates (such as 5 credits per container, capped at 20 credits per tracked shipment) are listed on our Pricing page and may be updated with notice.

Payments are processed by a third-party Merchant of Record assigned to your checkout session. For a given purchase the seller of record is either Creem.io or Waffo, who handles invoicing and applicable taxes for that transaction. Your use of their hosted checkout may also be subject to that provider’s terms.

Purchased credits are valid for 12 months from purchase. Free signup credits are valid for 30 days. Expired credits are forfeited.

Credits are not legal tender, carry no cash value, and are non-transferable. Unused credits are non-refundable except where a refund is required by applicable law or granted at our discretion.

4. Acceptable use

You may not: resell or redistribute the Service or its data without written permission; scrape, crawl, or bulk-extract data beyond your credit-based usage; reverse engineer the Service; use the Service for unlawful purposes; or interfere with its operation or security.

You may not submit tracking numbers or other data you are not authorized to process, or use the Service to monitor shipments solely to harm a third party.

5. Data accuracy disclaimer

Shipment milestones, ETAs, vessel positions, and schedules depend on third-party sources and are provided for informational purposes only. We do not warrant their accuracy, completeness, or timeliness.

The Service is not a substitute for official carrier documentation. Do not rely on it as the sole basis for customs, insurance, demurrage, or other commercial decisions.

6. Intellectual property

The Service, including its software, design, and branding, is owned by ShipmentBeat and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

7. Third-party services

The Service integrates third-party services including payment processing (Creem.io and Waffo), identity infrastructure, bot protection, hosting, and email delivery. Your use of those services may be subject to their own terms and privacy policies.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIPMENTBEAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE.

Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination for violation, remaining credits are forfeited.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on this page with an updated revision date. Continued use of the Service after changes take effect constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute through good-faith negotiation; failing that, disputes shall be submitted to a court of competent jurisdiction.

If mandatory consumer or data-protection law in your country of residence cannot be waived, those mandatory rights remain available to you.
